This Data Processing Information page is intended to help business customers understand how Franshys handles the data ("Customer Data") that a customer organization submits to, or generates within, the Franshys application when using our Services. It supplements our Terms of Service (see Section 5, "Customer data") and our Privacy Policy, and should be read alongside our Security page.
As between Franshys and a business customer, the customer retains ownership of the Customer Data it submits to the Services, consistent with our Terms of Service. Where Customer Data includes personal data about the customer's own end-customers, employees, or other individuals, the business customer generally acts as the controller (or equivalent) of that personal data, and Franshys acts as a processor (or equivalent), processing Customer Data solely to provide, maintain and improve the Services under the customer's instructions as reflected in our Terms of Service and applicable order forms. Franshys is granted a limited license to host and process Customer Data for these purposes; Franshys does not use Customer Data for purposes unrelated to providing the Services except as described in our Privacy Policy.
Franshys uses a limited number of third-party service providers ("subprocessors") to help deliver the Services. See our Subprocessors page for the current list of subprocessors we have identified, including their purpose.
Franshys personnel and contractors with access to Customer Data are subject to confidentiality obligations, consistent with Section 7 ("Confidentiality") of our Terms of Service. Access to Customer Data is limited to what is reasonably necessary to provide and support the Services.
Franshys applies technical and organizational measures designed to protect Customer Data. See our Security page for a description of these measures, including payment security, data encryption, access controls and incident handling.
If an individual (for example, an end-customer, employee, or other data subject of one of our business customers) wishes to make a request regarding their personal data held within a customer's Franshys account — such as a request to access, correct, or delete that data — they should generally contact the relevant business customer directly, since that customer controls the data. Where such a request is instead received by Franshys, we will route it to the relevant business customer and provide reasonable assistance to help the customer respond, consistent with our role as a processor. Requests and questions about this process can be sent to support@franshys.com.
Franshys retains Customer Data for as long as reasonably necessary to provide the Services to the applicable customer, or as otherwise agreed in an order form. Upon termination of a customer's subscription, Customer Data export may be available for a limited time as documented in product support resources, consistent with Section 10 ("Termination") of our Terms of Service. Customers seeking deletion of their Customer Data, or clarification on retention for a specific account, should contact support@franshys.com.
Franshys is based in India, and Customer Data may be accessed, hosted, or processed in connection with the Services from India and, where a subprocessor is used, from the location(s) where that subprocessor operates as described on our Subprocessors page. Where a transfer of personal data across borders is subject to specific legal requirements applicable to a customer, the customer should contact sales@franshys.com to discuss appropriate contractual safeguards.
If Franshys confirms a security incident affecting a business customer's Customer Data, Franshys will notify the affected business customer without undue delay, using the contact details on file for that customer's account. This page does not commit to a specific notification timeframe (such as a fixed number of hours or days); notification timing depends on the nature of the incident, our investigation, and any applicable legal or regulatory requirements.
Enterprise customers who require a formal, signed Data Processing Agreement should contact sales@franshys.com. A member of our team will work with you on the appropriate documentation for your organization. This page is not itself a DPA and does not create contractual obligations beyond those in your applicable order form and our Terms of Service.
